9. Hosting

We inform you that your data is kept and stored for the entire duration of their retention on the servers of the company OVH, located in France, 2 rue Kellermann - 59100 Roubaix in the European Union. Your data will not be transferred outside of the European Union as part of the use of the services we offer you.

1. Definition and Nature of Personal Data

When using the website accessible at www.solisysteme.fr (hereinafter the "Platform"), which allows professional resellers and/or individual or professional buyers to consult our product catalogs. In this context, we collect the following data:

1.1 Information you provide to us

For the proper execution of the services we offer through the Platform, including payment services, we collect the following data:
• Information enabling your identification when opening your account or making a payment: name, surname, email address, postal address, phone number
• Payment-related information: credit card numbers. We do not collect your BIC or IBAN in case of payment by transfer or check
• Any information you choose to communicate to us, especially when you leave a review or provide us with information regarding the execution of an order

1.2 Information we collect automatically when you use the Platform

When you use the Platform and for the proper execution of the services, we may also collect personal data about you automatically through the tools and services offered on the Platform. We may collect the following data:
• Usage information of the tools and features of the Platform: we collect information about your interactions with the Platform, including the pages or content viewed on the Platform, the links you clicked on
• Connection information and information about the equipment and devices you use to connect to the Platform: we collect device connection data when you access and use the Platform, even if you have not opened an account on our Platform, including your IP address, dates and times of connection, data related to the hardware and software used, unique identifiers, crash data, pages viewed or displayed before or after logging into the Platform
• Information about payment transactions: date and time of payment in case of payment by credit card, payment method used, expiration date of the payment method, amount of the payment.

2. Object of this charter

This charter aims to inform you about the measures we implement to collect and process your personal data, in strict compliance with your rights. We hereby inform you that we comply with the law n° 78-17 of January 6, 1978, relating to data processing, files, and freedoms, in its current version, as well as the General Data Protection Regulation.

3. Identity of the data collection and processing controller

The entity responsible for the collection and processing of your personal data is Solisysteme, a single-member limited liability company registered with the Poitiers Trade and Companies Registry under number B 418 295 341 RCS, with its registered office located at 11 Route de la Cour d'Henon, 86170 Avanton (referred to herein as "We").

4. Collection and Processing of Personal Data

Your personal data is collected and processed to fulfill one or more of the following purposes:

I - Manage your access to the Platform and the services available on the Platform and their use, as well as respond to any requests regarding your use of the services,

II - Perform operations related to the management of our customers and resellers, in connection with the use of our services, concerning contracts, orders, deliveries, invoices, loyalty programs, customer relationship management,

III - Establish a file of registered members, users, customers and prospects, resellers,

IV - Send newsletters or any informative messages related to our news and/or any developments of our services. In case you do not wish to receive them, we give you the opportunity to express your refusal on this subject during the collection of your data;

V - Send advertisements, including advertisements for our products and services but also for products and services marketed by the companies Jardimat, Thiebaut Industrie, Aluconcept, KSM Production and Voréal, members of the Burgermeister Group, including targeted advertisements. In case you do not wish to receive them, we give you the opportunity to express your refusal on this subject during the collection of your data.

VI - Communicate your identification data to members of the Burgermeister Group, i.e., to the companies Jardimat, Thiebaut Industrie, Aluconcept, KSM Production and Voréal. In case you do not wish to receive them, we give you the opportunity to express your refusal on this subject during the collection of your data.

VII - Develop statistics on the use and attendance of our services,

VIII - Manage the management of people's opinions on products, services or content,

IX - Manage any outstanding payments and disputes regarding the use of our products and services,

X - Comply with our legal and regulatory obligations, We inform you, when collecting your personal data, if certain data must be provided or if it is optional. We also indicate the possible consequences of not responding.

5. Recipients of collected and processed data

The staff of our company, control services (including auditors), and our subcontractors will have access to your personal data. When the execution of your order requires involvement of one of our resellers, we also provide them with the necessary data for order fulfillment.

Unless you refuse at the time of data collection, we will also communicate your identification data, as detailed in Article 1 of this Charter, excluding other data, to the companies Jardimat, Thiebaut Industrie, Aluconcept, KSM Production, and Voréal, which are subsidiaries together forming the Burgermeister Group. Each of these companies may use them for the same purposes and under the same conditions as outlined in this Charter. However, each company remains solely responsible for complying with its legal and declarative obligations in the processing of your personal data that it carries out on its own, using its own means, and for its own purposes.

We are only responsible for our use of your personal data, excluding any other uses by any of the companies of the Burgermeister Group. Public bodies may also be recipients of your personal data, exclusively to meet our legal obligations, as well as legal auxiliaries, ministerial officers, and organizations responsible for debt collection.

6. Transfer of personal data

Your personal data will not be transferred, rented, or exchanged for the benefit of third parties, except to our resellers who will be responsible for fulfilling your orders.

By exception and if you give us your consent, we may transmit your personal data to the companies Jardimat, Thiebaut Industrie, Aluconcept, KSM Production, and Voréal.

However, please be informed that we reserve the right to communicate entirely anonymized and aggregated data to third parties, meaning in a form that does not allow you to be identified in any way.

7. Data Retention Period for Personal Data

I - Concerning data relating to the management and monitoring of relationships with users of our services:
Your personal data will not be kept beyond the time strictly necessary for the management of our relationship with you. However, data allowing proof of a right or contract, which must be kept in compliance with a legal obligation, will be kept for the period provided by the law in force, i.e., a period of five (5) years. We keep your data for a maximum period of three (3) years from the collection of your data or from the last contact from the user or from the closure of your account on the Platform. At the end of this three (3) year period, we may contact you to inquire if you wish to continue receiving information about our services.

II - Concerning data relating to credit cards: Financial transactions relating to the payment of transactions made by credit card via the Platform are entrusted to a payment service provider who ensures their smooth running and security. For the needs of the services, this payment service provider may be the recipient of your personal data relating to your credit card numbers, which it collects and keeps on our behalf. We do not have access to this data.

To allow you to regularly make payments on the Platform, your data relating to your credit cards are kept for the duration of your registration on the Platform and at least until the moment you make your last transaction. By ticking the box expressly provided for this purpose on the Platform, you give us your express consent for this retention. Data relating to the visual cryptogram or CVV2, inscribed on your credit card, is not stored. If you refuse that your personal data relating to your credit card numbers be kept under the conditions specified above, we will not keep this data beyond the time necessary to allow the transaction to be carried out.

In any case, data relating to these transactions may be kept, for evidential purposes in the event of a possible challenge to the transaction, in intermediate archives, for the period provided for by Article L 133-24 of the Monetary and Financial Code, namely thirteen (13) months following the debit date. This period may be extended to fifteen (15) months to take into account the possibility of using deferred debit payment cards.

III - Concerning the management of opposition lists to receive prospecting: The information allowing your right to object to be taken into account is kept for a minimum of three (3) years from the exercise of the right to object.

IV - Concerning statistics for audience measurement: Information stored in users' terminal equipment or any other element used to identify users and allow their traceability or frequency will not be kept for more than thirteen (13) months.

V - Concerning the archiving of data relating to banking operations: At the end of the data retention period as specified above, we inform you that we archive your data for a period of two (2) years to meet our legal obligations, particularly in terms of combating banking fraud and money laundering.

We inform you that we take all necessary precautions, appropriate organizational and technical measures to preserve the security, integrity, and confidentiality of your personal data and, in particular, to prevent it from being distorted, damaged, or accessed by unauthorized third parties.

We also use advertising cookies. These cookies are only deposited if you give your consent. You have the option to disable these cookies in your web browser settings. We use Google Analytics, which is a statistical audience analysis tool that generates cookies to measure the number of visits to the Platform, the number of pages viewed, and the activity of visitors. Your IP address is also collected to determine the city from which you are connecting. The retention period of this cookie is mentioned in Article 7 - V of this charter. We remind you that you can oppose the deposit of technical cookies and cookies generated by Google Analytics by configuring your browser. However, such refusal could prevent the proper functioning of the Platform.

11. Consent

When you choose to provide your personal data for the purpose of executing the services we offer through our Platform, you expressly consent to the collection and processing of such data in accordance with the terms set forth in this charter and applicable laws. For any use of your data not covered by this Charter, we will seek your consent again before any new processing.

12. Access to your personal data

In accordance with the law n° 78-17 of January 6, 1978 relating to data processing, files and freedoms, as well as the GDPR, you have the right to access your data to obtain communication and, if necessary, rectification or erasure, through online access to your file.

It is reminded that any person may, for legitimate reasons, request the limitation of the processing of data concerning them or oppose such processing. We will inform you that in case of rectification or erasure of your personal data, as well as limitation of processing, carried out following a request from you, we will notify such modifications to the persons to whom we have communicated your data, unless such communication proves impossible.

13. Data portability

You have the right to data portability of the personal data you have provided to us, understood as the data that you have actively and consciously declared in the context of accessing and using the services, as well as the data generated by your activity in the context of using the services. We remind you that this right does not apply to data collected and processed on a legal basis other than consent or the performance of the contract binding us.

This right can be exercised free of charge, at any time, including when closing your account on the Platform, in order to retrieve and retain your personal data. In this context, we will provide you with your personal data by any means considered useful, in an open standard format commonly used and machine-readable, in accordance with the state of the art.

14. Introduction of a complaint before a supervisory authority

You are also informed that you have the right to lodge a complaint with a competent supervisory authority (the French National Commission on Informatics and Liberty), in the Member State where you usually reside, work, or where the violation of your rights occurred, if you believe that the processing of your personal data subject to this Charter constitutes a violation of applicable laws.

This recourse can be exercised without prejudice to any other administrative or judicial remedy. Indeed, you also have the right to an effective administrative or judicial remedy if you believe that the processing of your personal data subject to this Charter constitutes a violation of applicable laws.

15. Data Breach Notification

If we detect a security breach in the processing of your data that may pose a high risk to your rights and freedoms, we will inform you as soon as possible. On this occasion, we will provide you with details about the nature of the breach encountered and the measures implemented to address it.

16. Changes

We reserve the right, at our sole discretion, to modify this charter at any time, in whole or in part. These modifications will take effect upon publication of the new charter. Your use of the Platform following the entry into force of these modifications shall constitute acknowledgment and acceptance of the new charter. If you do not agree with this new charter, you should refrain from accessing the Platform.
